New Delhi: Congress leader Mallikarjun Kharge on Saturday, November 3, 2018, moved the Supreme Court against the decision to send CBI director Alok Verma on leave, saying it was “illegal” and in violation of the CBI Act.

In his petition, Mr. Kharge, who is the leader of the Congress in the Lok Sabha, said only the three-member committee comprising the Leader of the Opposition, Prime Minister and the Chief Justice of India can take a decision on the appointment or removal of the CBI director as per the Act.

The Central Vigilance Commission (CVC) had no power to act against the CBI director, he said.

“Prime Minister Narendra Modi’s suo motu action of sending CBI director Alok Verma on leave is illegal and is in violation of the CBI Act,” he said.

Sources in the Congress said the party had asked Mr. Kharge, who is a member of the committee, to file a petition in this regard.
